Chapter 7 Bankruptcy
Often called "wipe out" bankruptcy, Chapter 7 is a relatively quick process which results in the "discharge" (elimination) of most debts. Which assets you keep depends on your equity and the allowable exemption amounts.
Qualification is based on income.
Chapter 7 shows for 10 years on your credit report.
Chapter 13 Bankruptcy
Chapter 13 is known as "repayment plan" bankruptcy, and involves reconfiguring your debts into one, more affordable, lump-sum payment based on your income and other monthly expenses.
You generally get to keep your assets, stop foreclosure and repossession, and may even eliminate some unsecured debts.
Chapter 13 shows for 7 years on your credit report.
Student Loan Relief
The latest DOJ guidance provides objective standards and streamlined processes for discharging student loans in bankruptcy. Success rates for applicants exceed 85%, with courts accepting those recommendations 98% of the time, according to a 2024 letter from U.S. Senators Warren, Durbin, Whitehouse, and Warnock.
